Terms & Conditions
Applicable to all shipments tendered to Liberty Express Logistics LLC.
1. Acceptance of terms
By tendering a shipment to Liberty Express Logistics LLC ("the Carrier"), the shipper accepts these Terms & Conditions on behalf of themselves, the consignee and any other party with an interest in the shipment.
These terms apply to all bookings placed by phone, email or through this website, and supersede any conflicting terms printed on a shipper's own documentation unless expressly agreed in writing.
2. Carrier liability limitations
Liability for loss, damage or delay is limited by the mandatory international conventions applicable to the mode of transport used: the Montreal Convention for carriage by air, the Hague-Visby Rules and applicable maritime cargo regulations for carriage by sea, and the CMR Convention or applicable national road-haulage law for surface movements.
Where no convention applies, liability is limited to the lesser of the declared value of the goods or USD 100.00 per shipment. The Carrier is not liable for indirect, consequential, economic or special loss, including loss of profit, market or business opportunity, however arising.
The Carrier is not liable for delay, loss or damage caused by events outside its reasonable control, including acts of God, weather, industrial action, war, civil unrest, government or customs action, defects inherent in the goods, or inadequate packaging by the shipper.
Claims must be notified in writing within 14 calendar days of delivery, or within 21 calendar days of the scheduled delivery date where a shipment is not delivered. Claims submitted after these periods are time-barred.
3. Prohibited and restricted goods
The following are not accepted for carriage under any service level: currency, bullion and negotiable instruments; firearms, ammunition, explosives and their components; illegal narcotics and controlled substances; human or animal remains; live animals; counterfeit or infringing goods; hazardous or radioactive material not declared and approved in advance; and any item whose carriage, import or export is unlawful in the origin, transit or destination country.
Restricted goods — including lithium batteries, aerosols, flammable liquids, perishables, pharmaceuticals, alcohol and tobacco — may be carried only where declared in advance, correctly classified, packed and labelled in accordance with IATA Dangerous Goods Regulations or IMDG requirements, and accepted in writing by the Carrier.
The shipper is solely responsible for the accuracy of declarations. Shipments found to contain prohibited items may be held, returned or surrendered to the relevant authority at the shipper's cost, without compensation.
4. Package inspection policy
The Carrier, and any customs, aviation-security or law-enforcement authority in the origin, transit or destination country, may open and inspect any shipment at any time without prior notice to the shipper or consignee.
Where a shipment is opened for security screening it will be resealed and annotated. The Carrier is not liable for damage arising from an inspection lawfully conducted by a government authority, nor for delay caused by such inspection.
5. Shipment insurance options
All-risk cargo insurance may be purchased at the time of booking. Cover is quoted as a percentage of the declared commercial value of the goods plus freight charges, and must be arranged before the shipment is collected.
Insurance is optional and is separate from the Carrier's limited liability described in section 2. Where insurance is not purchased, compensation is capped at the convention or contractual limits in section 2 regardless of the actual value of the goods.
Certain goods are uninsurable, including items of extraordinary value, unpacked fragile goods, and shipments without adequate proof of value such as an invoice or purchase receipt.
6. Charges, duties and taxes
Quoted rates are based on the greater of actual and volumetric weight. The Carrier may reweigh and remeasure any shipment and adjust charges accordingly.
Import duties, taxes and clearance fees are payable by the consignee unless a delivered-duty-paid arrangement has been agreed in writing. Where the consignee refuses payment, the shipper remains liable for all charges, including return freight and storage.
7. Delivery, transit times and refusal
Transit estimates and tracking milestones are indicative and do not constitute a guaranteed delivery time unless a written time-definite service has been purchased.
Undeliverable shipments are held at the destination hub for 10 business days, after which storage charges apply. After 30 days, the Carrier may return, dispose of or sell the goods and apply the proceeds against outstanding charges.
8. Governing law
These terms are governed by the laws of the State of New York, United States, without prejudice to the mandatory application of the international conventions referenced in section 2. The parties submit to the exclusive jurisdiction of the courts of that State.
